PayPal Debit Card Agreement



This PayPal Debit Card Agreement ("Agreement") is a contract between you and PayPal and applies to your use of PayPal’s Debit Card. This Agreement applies to you in addition to the User Agreement and other applicable agreements. All capitalized terms shall have the definitions provided in this Agreement, or if a definition is not provided in this Agreement, the definition in the User Agreement shall apply. You must read, agree with and accept all of the terms and conditions contained in this Agreement. We may amend this Agreement at any time by posting a revised version on our website. The revised version will be effective at the time we post it. In addition, if the revised version includes a Substantial Change, we will provide you with 30 Days' prior notice of Substantial Change by posting notice on the "Policy Updates" page of our website. We last modified this Agreement on November 10, 2008.

  1. Eligibility. The PayPal Debit Card (the "Debit Card") is offered to PayPal users that are located in the United States. To be eligible to use the Debit Card you must meet the following requirements:

    • Have a Premier or Business Account in good standing for at least 60 days.

    • Have a credit card and a Verified bank account attached to your Account.

    • Have a confirmed address on file for your Account.

  2. Obtaining and activating your Debit Card. PayPal retains the sole discretion to accept or reject any application for a Debit Card. Statements and transaction information will be available on the PayPal website and not by mail.

    Once you receive your Debit Card in the mail, you can activate it by logging into www.paypal.com and following the instructions at the "Activate Debit Card" link on the Account Overview page, including selection of a Personal Identification Number ("PIN").

  3. Linking a Backup Funding Source to your Debit Card. Once you activate your Debit Card, you can link a Verified bank account, your PayPal Buyer Credit Account, or your PayPal Plus Credit Card as a Backup Funding Source to the Debit Card. Having a Backup Funding Source enables you to make Debit Card transactions when your Balance is insufficient to fund the transaction.

    To add a Backup Funding Source or to edit your Backup Funding Source preferences, log into your Account, go the “Profile” page, select “Debit Card” and add/edit your Backup Funding Source preferences.

  4. Using your Debit Card.

    • Using your Debit Card at an ATM. You may use your Debit Card at any ATM that is part of the Maestro/Cirrus ATM network. You may use your Debit Card at such an ATM to perform the following types of transactions:

      1. Withdraw cash from your PayPal Account Balance, or

      2. Find out your PayPal Account Balances.

      Note: To withdraw cash from your PayPal Account, choose "Checking Account" when given the option at an ATM.

    • Using your Debit Card to pay for purchases. You may use your Debit Card to purchase goods and services from merchants that accept MasterCard, in an amount up to your available PayPal Account Balance. In addition, if you have a Backup Funding Source linked to your Debit Card, you may use the Debit Card for purchases up to your available Balance combined with the available limit on your Backup Funding Source, subject to the limitations in section 6 below.

      Please note that if your payment is refunded, it will always be refunded to your Balance even if the purchase was funded in whole or in part with your Backup Funding Source.

  5. Fees.

    ATM Withdrawal US $1.00

    (Plus any amounts charged by the ATM owner.)
    Signature Withdrawal $3.00 if a signature is required.
    Non-US ATM Transaction

    (Using an ATM machine that is not in the US)
    1%

    This fee will apply even if the transaction does not require a currency conversion.
    Non-US Debit Card Usage

    (Making a purchase from a seller that is not in the US)
    1%

    This fee will apply even if the transaction does not require a currency conversion.
    Exchange Rate & Fee The currency exchange rate is determined by PayPal based on the current market price and includes a 2.5% Fee. This Fee only applies when PayPal performs the currency conversion.


  6. PayPal Preferred Rewards - Cash Back.

    1. Cash Back. The PayPal Preferred Rewards program provides 1% cash back on the net amount of your eligible monthly purchases.

    2. Eligibility.

      1. To be eligible for cash back, the Debit Card purchase must be an online or signature-based purchase that does not require a PIN (personal identification number). Some merchant locations offer you the option of choosing “Credit” or “ATM/Debit” when making a payment. To qualify for cash back, you must choose “Credit”.

      2. Your PayPal Debit Card must be in good standing at the time you make an eligible purchase and when PayPal makes the cash back payment.

      3. If you sell on eBay or other websites, you must enroll in the PayPal Preferred Program and turn on the “Tell Buyers that I prefer PayPal payments” preference.

  7. Spending Limits. For your protection, your Debit Card is subject to the following limits:

    1. $400.00 daily limit for ATM withdrawals and other cash like withdrawals (cash advances and money transfers), and

    2. $3,000.00 daily limit for purchases, and a $1,000 daily limit for purchases where you user your bank account as the funding source, and

    3. Daily limit of 30 transactions, and

    4. Monthly usage limit of $50,000.

  8. Preauthorization Holds. When you use your Debit Card to purchase goods or services or to obtain cash from a merchant, the merchant may attempt to obtain preauthorization from us for the transaction. If the merchant makes such a request, we place a 4 Day hold on your Account for the amount of the preauthorization request (which may vary in some cases from the amount of the actual purchase, depending on the merchant). This hold may affect the availability of funds from your Account (to pay for transactions. We will not be responsible if any transactions are not completed because of the hold. If the preauthorization request varies from the amount of the actual transaction, and in the event that we cannot charge your Backup Funding Source, we will debit the entire transaction amount from your Balance, even if this results in your Balance becoming negative.

  9. Personal Identification Number/Your Electronic Signature. Your PIN is a security code, which has been designed to protect your transaction account against unauthorized use. The PIN provides enhanced security for your Account and must be used when making transactions to your Account. It is your electronic signature. Since the PIN is for security purposes, you should memorize it and it should not be disclosed to anyone. You can change your PIN at any time, and a temporary hold can be placed on your Account if the PIN has been compromised or if your Debit Card is lost or stolen. Maintaining the security of your PIN and Debit Card is your responsibility.

  10. Ownership Changes. If you authorize a name change on your Account (limited to a change due to either a divorce, marriage or birth certificate change), it will be your responsibility to destroy your old Debit Card, as well as obtaining a new PIN, or you may be liable for any losses which may occur.

  11. Requesting a second Debit Cards attached to Account. Current Debit Card holders who continue to meet the original Debit Card eligibility requirements may request a second Debit Card. The primary cardholder warrants and agrees that he or she will be liable for all charges incurred by the secondary cardholder to the same extent and as if they were charges made by the primary cardholder.

Student Account Agreement



This Student Account Agreement ("Agreement") is a contract between you (the Parent) and PayPal and applies to your use, and the Child's use, of the Student Account and the PayPal Services.

PLEASE READ THIS AGREEMENT CAREFULLY. BY ACCEPTING THIS AGREEMENT AND OPENING A STUDENT ACCOUNT, YOU AGREE TO BE FULLY LIABLE AND RESPONSIBLE FOR ALL OF THE CHILD'S ACTIONS, OBLIGATIONS, AND LIABILITY RELATED TO THE STUDENT ACCOUNT AND THE PAYPAL SERVICES. IN ORDER TO OPEN A STUDENT ACCOUNT FOR A MINOR, YOU MUST BE THE MINOR'S LEGAL GUARDIAN, PARENT, OR RELATIVE.

This Agreement applies in addition to the User Agreement and other applicable agreements. All capitalized terms shall have the definitions provided in this Agreement, or if a definition is not provided in this Agreement, the definition in the User Agreement shall apply. We last modified this Agreement on November 10, 2008.

  1. Eligibility. To open and maintain a Student Account, you must have a U.S. PayPal Account in good standing with a verified bank account and confirmed address.

  2. Student Account. A Student Account is a PayPal Account with limited features that is available to people age 13 and above.

  3. Student Account features. The Student Account features include but are not limited to the following:

    1. Balance funded account. A Student Account is a Balance funded account. All purchases made by the Child must be funded with the Balance held in the Student Account. The Student Account does not have a linked credit card or bank account.

    2. Fees. There is no charge to open a Student Account and to transfer money from the Master Account to the Student Account. Unless upgraded, Student Accounts are Personal Accounts and subject to all of the Fees applicable to a Personal Account. In order for a Student Account to receive a Card Funded Payment, the Parent will have to upgrade the Student Account to a Premier Account. Once the Student Account is upgraded to a Premier Account all of the Premier Account Fees shall apply, except that transfers from the Master Account to the Student Account, and between multiple Student Accounts under one Master Account, will remain free. Parents should advise the Child that Fees will apply to money received into the Student Account if it is upgraded to a Premier Account. See section 8 of the PayPal User Agreement for Fees.

    3. Parent control. Below are some of the actions that the Parent may take:

      1. Transfer money in to the Student Account. The Parent may transfer money from the Master Account to the Student Account using money in the Parent’s PayPal Balance. If the Parent does not have funds in his or her PayPal Balance, the Parent may transfer money into the Student Account from the Parent’s bank account.

      2. Transfer money out of the Student Account. The Parent may transfer money from the Student Account to the Master Account.

      3. Control money received by the Student Account. The Parent is required to "approve" money received by the Student Account unless the Parent sets the Permissions to allow such payments. If the Parent does not "approve" money that is sent to the Student Account within 30 days, the money will be returned to the sender.

      4. Set Permissions. The Parent may set Permissions to allow or prevent the Child from:

        1. Making purchases online using the PayPal Student Account.

        2. Sending money to PayPal users.

        3. Receiving money from PayPal users without a Parent approval.

        4. Using the PayPal Student Account Debit Card ("Student Debit Card"). Use of the Student Debit Card is subject to the terms and conditions attached as "Exhibit A".

      5. Set alerts. The Parent may set alerts to be notified when: (a) the Student Account Balance drops below an amount set by the Parent, and/or (b) a payment made by the Child equals or exceeds an amount set by the Parent.

      6. View Student Account activities. The Parent View allows the Parent to have a limited view of the Student Account activities. The Parent View shows the Student Account Balance that is held in U.S. dollars and Student Account transactions. The Parent View does not show amounts held in a currency other than U.S. dollars, or Gift Certificates or Redemption Codes.

      7. Close the Student Account. The Parent may close the Student Account at any time. In order to close a Student Account, you must first transfer the Balance to the Master Account. You may not close a Student Account if there is a negative Balance.

      8. Change Student Account password. The Parent may change the Student Account password at any time.

      9. Use of the PayPal Resolution Center. The Parent may use the PayPal Resolution Center to file Disputes or open Claims related to the Student Account. In addition, it is the Parent's responsibility to respond to Disputes or Claims that have been filed by PayPal users related to the Student Account. The Child will not have access to the PayPal Resolution Center.

    4. Child control. Below are some of the actions that the Child may take:

      1. Send money and make purchases. Unless the Parent changes the Permissions, the Child may use the Student Account to send money to and make purchases from PayPal users.

      2. Automatic Payments. The Child may use the Student Account to authorize Automatic payments to sellers. It is your responsibility to ensure that the Student Account Balance is sufficient to cover all Automatic Payments authorized by the Child.

      3. Use the PayPal Student Debit Card. The Child may use the Student Debit Card to make purchases online and offline and to withdraw amounts from the Student Account at Maestro/Cirrus ATM network locations.

      4. Use PayPal Mobile. The Child may activate a mobile telephone and use it to check his or her Student Account Balance and send payments.

      5. Add a new shipping address or change the email address. The Child may add a new shipping address or change the email address to the Student Account. In such an event, PayPal will send you an email informing you of the new shipping address or email address.

      6. Hold a Balance in a non-U.S. dollar currency. The Student Account may hold amounts in currencies other than U.S. dollars. Non-U.S. dollar amounts will not be available to make payments until the Child converts such amounts to U.S. dollars.

      7. Perform a currency conversion. If the Student Account has a Balance in a currency other than U.S. dollars, the Child may perform a currency conversion for a Fee. See section 8 of the PayPal User Agreement for Fees.

      8. Change Student Account password. The Student may change the Student Account password at any time.
  4. Liability. The Parent is liable and responsible for all of the Child's actions, obligations, and liability related to the Student Account and the PayPal Services. For liability purposes, the Master Account and any attached Student Accounts are considered one account for which the Master Account holder is responsible. Any action taken by PayPal on the Master Account may also apply to the Student Account(s) and any action taken by PayPal on the Student Account(s) may also apply to the Master Account. The Master Account holder agrees to be liable for a negative Student Account Balance should one occur. PayPal may recover amounts held in a Student Account if the Master Account holder owes any amounts to PayPal even if such liability is unrelated to the Student Account. Should a Student Account hold a negative balance for a period of 30 days or more, and/or if any other liabilities are charged to the Student Account, any such amounts past due may be taken from the Parent Account or other Student Accounts linked to the Master Account. Any online agreements that are accepted by the Child are accepted by the Parent as if the Parent had taken the action. The Parent is responsible for educating the Child on internet safety.

  5. Prohibited use. The Child may not use the Student Account to engage in activities deemed illegal by federal and/or state laws, including, but not limited to, internet gambling, the underage purchase of alcohol and tobacco, and purchases of adult oriented content. If you or the Child use the Student Account to engage in certain activities deemed illegal by federal and/or state laws, the Parent will nevertheless be liable for any such transactions. PayPal reserves the right to limit or close the Master Account and/or Student Account if PayPal believes that the Student Account is associated with a prohibited use.

  6. Right to amend. PayPal may amend this Agreement at any time by posting a revised version on the PayPal website. The revised version will be effective at the time we post it. If the revised version includes a Substantial Change, PayPal will provide you with 30 Days' prior notice of Substantial Change by posting notice on the "Policy Updates" page of the PayPal website.

  7. Definitions.

    1. “Automatic Payments” means payments that are automatically made from your PayPal Account to a seller. To make Automatic Payments to a seller, you must buy something and authorize the seller to directly charge your PayPal Account. You will authorize the seller to charge your PayPal account at the time you checkout. An example of Automatic Payments is when you sign up for an Apple iTunes account and authorize Apple to directly charge your PayPal Account for your iTunes purchases.

    2. "Child" means a person that is age 13 or older.

    3. "Master Account" means a PayPal Personal, Business, or Premier Account that has linked a Student Account.

    4. "Parent" means the Master Account holder and person responsible for the Child's actions.

    5. "Parent View" means the Student Account features viewable to the Parent from the Master Account.

    6. "PayPal Mobile" means PayPal's services available through a mobile phone.

    7. "Permissions" means default settings that can be set and changed by the Parent to allow or prevent the Child from using certain Student Account features.

    8. "Student Account" means a PayPal Account for a Child that is age 13 or older.



Exhibit "A"
Student Card Agreement

This Student Card Agreement ("Agreement") is a contract between you (the Parent) and PayPal and applies to your use, and the Child's use, of the Student Card and the PayPal Services.

PLEASE READ THIS EXHIBIT "A" CAREFULLY. BY APPLYING FOR AND RECEIVING A STUDENT CARD, YOU AGREE TO BE FULLY LIABLE AND RESPONSIBLE FOR ALL OF THE CHILD'S ACTIONS, OBLIGATIONS, AND LIABILITY RELATED TO THE STUDENT CARD AND THE PAYPAL SERVICES.

  1. Receiving and activating the Student Card. The Parent must apply for the Student Card. PayPal retains sole discretion to accept or reject any application for a Student Card.

  2. Using the Student Card.

    1. Purchases and ATM withdrawals. The Child may use the Student Card to make purchases anywhere MasterCard is accepted and to withdrawal amounts at any ATM that is part of the Maestro/Cirrus ATM network. Purchases and withdrawals should not exceed the amount of the Student Account Balance.

    2. Parent suspension. The Parent may suspend the Child's use of the Student Card by changing the Student Account Permissions.

    3. Fees.

      ATM Withdrawal US $1.00

  3. ATM withdrawal and spending limits. Student Card transactions are subject to a daily limit of $150.00 for ATM withdrawals and cash like withdrawals (e.g. cash advances and money transfers), a $500.00 daily limit for purchases, and a $2,000 monthly limit for all Student Card transactions. PayPal retains sole discretion to apply and change these limits.

  4. Preauthorization holds. Sellers may ask PayPal for a preauthorization prior to allowing a Child to use the Student Card. In such case, PayPal may place a four-day hold on the funds in the Student Account Balance equivalent to the amount of the preauthorization request. If the preauthorization request is less than the amount of the actual transaction, PayPal will debit the amount of the actual transaction from the Student Account, even if this results in a negative balance. For example, if a gasoline station requests a preauthorization for $40.00 prior to allowing the Student to pump gasoline, and the Student Account has a $45.00 Balance, PayPal will provide an authorization for the purchase. If the Student then pumps $50.00 in gasoline, the Student Account will be charged $50.00 and the Student Account will have a $5.00 negative Balance. A preauthorization hold may restrict the Child's ability to use some or all of the amounts in the Student Account during the hold period. PayPal is not responsible for any transactions that are not completed because of the hold.

  5. Personal identification number/electronic signature. The Child's PIN is a security code designed to protect the Student Account against unauthorized use. The Child should memorize the PIN and avoid sharing the PIN with anyone. The PIN is originally requested by the Parent, which will then be delivered to the Child. After receiving such, the Child can change the PIN at any time. PayPal may place a temporary hold on the Student Account if the PIN has been compromised or if the Student Card is lost or stolen. Should be PIN or Student Card become lost or stolen, the Child or Parent shall immediately notify PayPal by calling the PayPal customer service center.

  6. Third party liability. The Parent shall be liable for any transactions made by a person that the Student or Parent authorizes or permits to use the Student Card.

  7. Rewards and cash back. Use of the Student Card does not have a rewards or cash back program.
